Ghana Import Duty – How to get an Import Duty Refund

Did you know that the Ghana Revenue Authority gives import duty refunds? According to Section 104 of the Customs Act 2015, Act 891, the Authority can repay an amount of customs import duty paid on goods imported into Ghana.

The Authority may refund the import duty in 2 ways:

  1. Waive the payment of import duty that is yet to be paid
  2. Refund an amount of import duty that has already been paid

When are Ghana Import Duty refunds given?

1. Under a Commissioner-General directive

  • The Commissioner-General of the Ghana Revenue Authority may direct that goods abandoned by the owner are not worth the duty payable, and then direct the officer in charge to destroy or dispose of them at the expense of the owner.

2. When the terms of a Contract of Sale are violated

  • An import duty refund is given when goods that you import and pay duty for do not match their description, state, quality, or condition as indicated in the contract at the time of release from customs custody. The refund is issued after you return the goods to the supplier, abandon the goods according to the GRA procedures, or destroy the goods under customs control.
  • Note that you will only get a refund if the goods have not been used after release from Customs.

3. When duty is paid before the forfeiture of goods

  • You can get a refund if duty was paid before the forfeiture of goods, and these goods are confirmed to have been forfeited under the Customs Act 2015, Act 891.

4. When goods are shipped without the consent of the Consignee and duty has been paid

  • You can get an import duty refund if your goods are not shipped, if they are returned to the consignor or if they are abandoned to the Authority or destroyed under the supervision of the Authority.

5. When you have an unaccrued penalty

  • In this instance, you will get a refund if you pay money as a penalty, and then the Authority finds that the penalty did not accrue, the penalty accrued was less than the amount paid, or is mitigated to less than the amount paid.

6. When you pay duty on goods that are then lost by accident

  • Here, the Authority will refund the amount paid as Ghana import duty if the goods were on board a conveyance in a Customs-controlled area or warehouse, or if they were in the process of being removed into or delivered from a Customs-controlled area or warehouse.

7. When you have an overpayment of duty

  • When you make an overpayment on the duty due, the Authority will give you a refund.

8. When the duty payable or paid by a person is on goods pre-entered

  • This duty is refundable when the Authority ascertains that the goods are lost and will not be imported into the country, or the goods are yet to be imported into the country 12 months after they are pre-entered.

9. When the charges paid are erroneous

  • If you pay any charges other than duty, and the Authority determines that these charges were erroneous or excess in terms of collection and assessment, your import duty will be refunded.

When should you claim an import duty refund?

  • All claims should be done within 90 days of the date of release of the goods from the Custom’s custody.
